Silver & Wright LLP Founding Partner Curtis R. Wright provided insight on cannabis enforcement to the County Counsels’ Association 2019 Fall Land Use Study Section Conference on Dec. 5.
Wright, alongside the County of El Dorado’s Deputy County Counsel Breann M. Moebius, discussed topics surrounding cannabis enforcement and took questions for more than an hour from the county attorneys in attendance.
The pair’s session, “Administrative Enforcement & Effective Abatement of Cannabis,” covered increasingly significant issues for counties that need to address ever-changing cannabis regulations such as black market enforcement, administrative citations, home cultivation, the Drug Abatement Act, and receiverships, among others.
“We have significant experience helping local governments protect their residents’ health and safety by combating illegal cannabis operations,” said Wright. “Since Californians voted in 2016 to legalize the sale of recreational cannabis, cities and counties have been challenged to anticipate and adapt to constantly changing rules and regulations. Silver & Wright can help municipalities address illegal and unsafe markets in their jurisdictions. Our participation in this symposium exemplifies our role as innovative leaders with a deep understanding of the best strategies for enforcing local ordinances.”
Wright and Moebius allowed the audience to lead the conversation and ask questions so the duo could offer insight and knowledge regarding the matters significant to their counties.
“Like many local jurisdictions, El Dorado County continues to face challenges in developing an effective enforcement program for an industry that has historically thrived in the illicit market,” said Moebius. “Code enforcement is one tool we are utilizing in lieu of criminal prosecution. Neutral hearing officer services, such as those Silver & Wright provide, are critical to pursuing abatement during the relatively short growing season and obtaining administrative fines that can withstand legal challenges.”
