County Of Mariposa And Its Attorneys Silver & Wright LLP Support Another Continuance In The Jerry Cox Case To Allow Him More Time To Find An Attorney

Nov 10, 2020

Jerry Cox, the managing partner of JDC Land Co., LLC, the defendant in an ongoing Mariposa County nuisance abatement case, appeared at a court hearing today without an attorney. The defendant in the case is JDC Land Company, LLC, the company into which Mr. Cox put the property. Mr. Cox can’t represent JDC Land Co., in court because, under State law, a corporation must be represented by an attorney, which he is not.

The County and its attorneys Silver & Wright LLP supported another continuance to allow Mr. Cox additional time to obtain a new attorney for his company or convince his existing attorneys representing him in another related matter to assist in this case.

“We felt it was the right thing to do out of fairness to Mr. Cox and his situation.”

John Fujii, Partner at Silver & Wright LLP

The Court continued the status conference to January, at which time it will set a new date for the hearing on the Court receiver’s discharge. This will specifically address two issues relating only to the Court receiver: 1) if the receiver fixed the violations of law on the property, and 2) the Court receiver’s final accounting for his fees and the abatement costs. The County and its attorneys S&W LLP vigorously object to the Court receiver’s fees and have filed a detailed objection in Court. Regardless of whether JDC Land Co., LLC obtains legal representation, they will continue their effort to significantly reduce the receiver’s fees at the discharge hearing.

That status conference is scheduled for January 22, 2021.
